उत्तराखंड सरकार ने हाई कोर्ट में 78 पेज का हलफनामा दायर कर कहा है कि समान नागरिक संहिता के तहत नियमों के कुछ प्रावधानों में संशोधन किया जा रहा है.
15 अक्टूबर को मुख्य न्यायाधीश जी नरेंद्र और न्यायमूर्ति सुभाष उपाध्याय की खंडपीठ के समक्ष महाधिवक्ता एसएन बाबुलकर द्वारा प्रस्तुत हलफनामे में कहा गया है कि संशोधन रजिस्ट्रार कार्यालय के नियम 380 से संबंधित हैं, जो उन शर्तों को सूचीबद्ध करता है जिनके तहत लिव-इन रिलेशनशिप को पंजीकृत नहीं किया जा सकता है।
इनमें वे स्थितियाँ शामिल हैं जहाँ युगल रिश्ते के निषिद्ध स्तर से संबंधित हैं, यदि एक या दोनों पहले से ही शादीशुदा हैं या किसी अन्य सहवास रिश्ते में रह रहे हैं, या यदि जोड़े में से एक नाबालिग है।
हलफनामे में कहा गया है कि प्रस्तावित बदलाव पंजीकरण और सहवास संबंधों को समाप्त करने की प्रक्रिया में सुधार, पुलिस के साथ जानकारी साझा करने में अधिक स्पष्टता प्रदान करने और खारिज किए गए आवेदनों के लिए अपील की अवधि बढ़ाने पर केंद्रित हैं।
संशोधित प्रावधान रजिस्ट्रार और स्थानीय पुलिस के बीच डेटा साझा करने के दायरे को सीमित करने का प्रयास करते हैं, जिससे यह स्पष्ट हो जाता है कि यह केवल “रिकॉर्ड-कीपिंग उद्देश्यों” के लिए किया जा रहा है।
प्रस्तावित संशोधनों में विभिन्न पंजीकरण और घोषणा प्रक्रियाओं में पहचान प्रमाण के रूप में आधार के अनिवार्य उपयोग से संबंधित परिवर्तन भी शामिल हैं।
इन परिवर्तनों का मुख्य उद्देश्य उन मामलों में वैकल्पिक पहचान दस्तावेजों की अनुमति देकर “लचीलापन” प्रदान करना है जहां आवेदक आधार प्रदान नहीं कर सकते हैं, खासकर उन मामलों में जहां वे प्राथमिक आवेदक नहीं हैं।
हलफनामे में यह भी कहा गया है कि एक संशोधन में सहवास की घोषणा को खारिज करने वाले रजिस्ट्रार के फैसले को चुनौती देने के लिए आवेदकों के लिए समय अवधि को अस्वीकृति आदेश प्राप्त होने की तारीख से 30 दिन से बढ़ाकर 45 दिन करने का प्रस्ताव है।
