उत्तराखंड में बड़े पैमाने पर अतिक्रमण और वन भूमि पर कब्ज़ा करने का स्वत: संज्ञान लेते हुए, सुप्रीम कोर्ट ने सोमवार को राज्य सरकार और उसके अधिकारियों को समस्या पर “मूक दर्शक” बने रहने के लिए फटकार लगाई।
“इस मामले के तथ्य प्रथम दृष्टया दिखाते हैं कि कैसे हजारों एकड़ वन भूमि को निजी व्यक्तियों द्वारा व्यवस्थित रूप से हड़प लिया गया है… हमारे लिए चौंकाने वाली बात यह है कि जब वन भूमि को उनकी आंखों के सामने व्यवस्थित रूप से हड़पा जा रहा है तो उत्तराखंड राज्य और उसके अधिकारी मूक दर्शक बनकर बैठे हैं। नतीजतन, हम इन कार्यवाहियों का दायरा बढ़ाने का प्रस्ताव रखते हैं। भारत के मुख्य न्यायाधीश सूर्यकांत की अगुवाई वाली विशेष अवकाश पीठ ने कहा, “नोटिस जारी किया जाए।”
“उत्तराखंड के मुख्य सचिव और प्रमुख संरक्षण सचिव को एक तथ्यान्वेषी समिति बनाने और एक रिपोर्ट प्रस्तुत करने का निर्देश दिया जाता है। निजी पार्टियों को किसी भी तीसरे पक्ष के अधिकार बनाने से रोका जाता है और कोई निर्माण नहीं होगा,” पीठ ने आदेश दिया जिसमें न्यायमूर्ति जॉयमाल्या बागची भी शामिल थे।
निजी संस्थाओं को विषयगत भूमि को हस्तांतरित करने या ऐसी भूमि पर तीसरे पक्ष के अधिकार बनाने से रोकते हुए, आदेश दिया गया कि संबंधित भूमि पर कोई निर्माण नहीं होगा और वन विभाग सभी खाली भूमि (आवासीय घरों को छोड़कर) पर कब्जा कर लेगा।
इसने मामले को छुट्टियों के बाद अदालत के दोबारा खुलने पर सुनवाई के लिए पोस्ट किया।
यह आदेश उत्तराखंड में वन भूमि के एक बड़े हिस्से पर कथित अवैध कब्जे को लेकर अनीता कंडवाल द्वारा दायर याचिका पर सुनवाई के दौरान आया।
यह मामला सरकारी वन भूमि के रूप में अधिसूचित 2866 एकड़ भूमि से संबंधित है – जिसका एक हिस्सा कथित तौर पर ऋषिकेश की एक सोसायटी को पट्टे पर दिया गया था, जिसने आगे चलकर अपने सदस्यों को भूमि के टुकड़े आवंटित किए। सोसायटी और उसके सदस्यों के बीच विवाद के बाद कथित तौर पर एक “मिलीभगत” डिक्री पारित की गई।
बाद में, सोसायटी परिसमापन में आ गई और इसने 23 अक्टूबर 1984 को 594 एकड़ भूमि वन विभाग को सौंप दी। सरकार में वन भूमि को फिर से निहित करने के बावजूद, कुछ निजी व्यक्तियों ने 2001 में भूमि पर कब्जा करने का दावा किया।
